These terms of sale govern every order of Japanese teas and brewing accessories placed on mizutea.ca with MIZU (working name; legal entity: [LEGAL ENTITY TO BE CONFIRMED]). Products are sold to consumers in Canada, with Canadian shipping first at launch. By placing an order, you acknowledge that you have read these terms and accept them.

Language of the contract

These terms are drafted in French and the French version prevails over any translation, including the English version provided for convenience. The contract is therefore formed in French, in accordance with the Charter of the French language.

Orders and your account

To order, you select your items, provide your shipping details and pay at checkout; a confirmation email summarizing the order is then sent to you. We may refuse or cancel an order in case of a pricing error, unavailability or suspected fraud; any amount paid is then refunded. You are responsible for the accuracy of your account information, the confidentiality of your password and all activity carried out through your account.

Prices, taxes and payment

  • Prices are displayed in Canadian dollars (CAD), before taxes;
  • Applicable taxes are calculated and shown at checkout: GST 5% and QST 9.975%;
  • Payment is made by card through Stripe; MIZU never collects or stores any card data.

Shipping and transfer of risk

Orders are prepared within a processing time of [PROCESSING TIME TO BE CONFIRMED], then shipped to the address you provide. Shipping options, rates and transit times are shown at checkout and detailed in the shipping & returns policy. Risk in the products transfers to you upon delivery, that is, when you or a third party you designated takes possession of them.

Legal warranties and returns

All products come with the legal warranty provided by the Civil Code of Québec and the Consumer Protection Act: the goods must be durable in normal use, match their description and be fit for the use ordinarily made of them. This warranty applies even without any additional written warranty and can be neither excluded nor limited. Returns, exchanges and voluntary warranties are governed by the shipping & returns policy, which forms an integral part of these terms.

Intellectual property

The site’s content (texts, photographs, logos, layout) is protected by copyright and remains the property of MIZU or its licensors; any reproduction or commercial use without written permission is prohibited. The MIZU name is used as a trademark with registration pending [TO BE CONFIRMED]. You are granted a limited, non-exclusive and revocable licence to browse the site and place orders on it.

Liability and force majeure

To the extent permitted by law, MIZU’s total liability for any damage related to an order or to the use of the site is limited to the amount paid for the product concerned. This limit, like any exclusion of liability, cannot apply to claims arising from the legal warranty or to the rights the Consumer Protection Act gives you, which can be neither excluded nor limited. MIZU is not liable for delay or failure to perform caused by an event beyond its reasonable control, such as fire, flood, strike, major disruption to transportation or networks, or an act of authority; its obligations are then suspended for as long as that event lasts.
